Overview. This website, northgalocal.com, is operated by The Bagby Agency, Inc. doing business as North GA Local ("we," "us," "our"). By visiting the Site or buying from us, you agree to these Terms of Service ("Terms"), along with our Privacy Policy, Refund Policy, and Shipping Policy. If you don't agree, please don't use the Site. Our store is hosted on Shopify.

1. Online store terms. By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence, or that you have given us consent to allow any minor dependents to use the Site. You may not use our products for any illegal or unauthorized purpose.

2. General conditions. We reserve the right to refuse service to anyone for any reason at any time.

3. Accuracy of information. We aren't responsible if information on the Site is not accurate, complete, or current. Content on the Site is for general information only.

4. Changes to prices and products. Prices are in US dollars and are subject to change without notice. We may modify or discontinue any product or the Site at any time without liability to you.

5. Products. Our shirts are made to order. We do our best to show colors and print placement accurately, but we can't guarantee your screen displays colors exactly, and garment dyed shirts naturally vary slightly from piece to piece. Measurements are approximate and may vary by up to 2 inches. Returns and refunds are handled under our Refund Policy.

6. Orders, fulfillment, and shipping. Orders are printed and shipped by our fulfillment partner, Printful, which receives the order details it needs to make and deliver your order. Production usually takes 2 to 5 business days before shipping. We ship only to addresses in the United States. Shipping is free on orders of $50 or more and a flat $5 otherwise. Delivery dates are estimates, not guarantees. Cancellations, lost packages, and incorrect addresses are handled under our Refund Policy and Shipping Policy.

7. Payments. Payments are processed securely through Shopify's checkout and its payment partners. We never see or store your full card number. You agree to provide current, complete, and accurate purchase and account information. We may refuse or cancel any order, limit quantities, or restrict orders that appear to be placed by dealers, resellers, or distributors. If we cancel an order after you've paid, we'll refund you in full.

8. Intellectual property. The North GA Local name and logo, our shirt designs and artwork, and the content of the Site are owned by The Bagby Agency, Inc. and protected by copyright and trademark law. Buying a shirt gives you the right to wear and enjoy it. It doesn't give you the right to copy, reproduce, sell, or otherwise use our designs or content without our written permission.

9. Third party tools and links. We may provide access to third party tools and links that we don't control. Your use of them is at your own risk and subject to their terms.

10. Comments and submissions. If you send us ideas, feedback, or other submissions, you agree we may use them without restriction or compensation. You agree your submissions won't violate anyone's rights or contain unlawful material.

11. Personal information. Your submission of personal information through the Site is governed by our Privacy Policy.

12. Errors and omissions. Occasionally the Site may contain errors in pricing, descriptions, availability, or shipping times. We reserve the right to correct errors and to cancel orders if information is inaccurate, including after you've submitted an order.

13. Prohibited uses. You may not use the Site for any unlawful purpose, to infringe our or others' intellectual property, to harass or harm anyone, to submit false information, to upload malicious code, or to interfere with the Site's security.

14. Disclaimer of warranties; limitation of liability. Except as stated in our Refund Policy, the Site and all products are provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. In no case shall The Bagby Agency, Inc., its owners, or its service providers be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Site or any product. Where liability can't be excluded, it is limited to the maximum extent permitted by law and to the amount you paid for the product.

15. Indemnification. You agree to indemnify and hold us harmless from any claim or demand arising from your breach of these Terms or your violation of any law or the rights of a third party.

16. Severability. If any part of these Terms is found unenforceable, the rest remains in full effect.

17. Termination. These Terms remain in effect unless terminated by you or us. You may terminate by no longer using the Site.

18. Entire agreement. These Terms and any policies we post on the Site are the entire agreement between you and us regarding the Site.

19. Let's talk first. If you have a problem with an order or with us, please email hello@northgalocal.com and tell us what happened and what you'd like us to do. Most issues can be fixed quickly. Before either of us files a lawsuit, we both agree to try in good faith to resolve the issue informally for at least 30 days after that email is received.

20. Governing law and venue. These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. Any lawsuit about these Terms, the Site, or your purchases must be brought in the state or federal courts serving Cherokee County, Georgia, and you and we agree to the jurisdiction of those courts. Either of us may still bring an individual claim in small claims (magistrate) court if it qualifies.

21. Changes to these Terms and our policies. We may update these Terms, our Privacy Policy, Refund Policy, and Shipping Policy by posting the changes on the Site and updating the "Last updated" date. Changes apply to orders placed after they're posted. Continued use of the Site after changes means you accept them.
